GENERAL CONDITIONS
1) DURATION (arrival and departure time)
The rental will begin from the moment of check-in, which will take place at 3.00 pm on the selected day and will end with check-out, which must take place no later than 10.00 am on the day selected for departure; except for a time extension to be agreed in advance and for a maximum number of people hosted, as indicated in the booking.
2) CANCELLATION RATES AND PENALTIES
In the event of a booking subject to a "standard" rate, the Tenant will be able to provide, without penalty, free cancellation (right of withdrawal) up to 15 days before the date established for the start of the rental (check-in), with communication to be sent by e-mail (e.g. [email protected]), with proof of receipt, of the communicated withdrawal, to be paid by the Tenant. Once the aforementioned deadline has passed, the Tenant, even in the event of cancellation of the booking (withdrawal), will instead be required to pay the entire agreed rental amount in favor of RomagnaBNB, as a penalty (penitential deposit).
In the event of a booking subject to a "non-refundable" rate, the Tenant, even in the event of cancellation of his/her booking, must always and in any case pay the full agreed amount to RomagnaBNB as a penalty (penalty deposit).
3) RENTAL FEE
The rental fee is agreed as per the selected rate for the contractual duration of the rental, and must be paid in full, in legal tender currency, by the Tenant to RomagnaBNB upon confirmation of the booking, as subsequently specified.
4) DEPOSIT
Based on the terms indicated in the art. 2, the Tenant, at the time of booking, is required to pay in full the overall price accepted for the provision of the booked services, as a deposit, which, at the time of check-out, will be converted into a deposit, with respect to any additional services provided or, in the absence of more services provided, it will be converted into a balance; always at check-out, a regular electronic invoice will be issued for the balance of the stay.
For stays booked with the "Standard" rate: payment in full must be made by the Tenant no later than 14 days before check-in.
For stays booked with a "Non-refundable" rate: full payment must be made by the Tenant upon confirmation of the booking.
5) CITY TAX
the Tenant is required to pay RomagnaBNB the amount relating to the City tax if applied by the Municipality where the property covered by the contract is located. This amount will be communicated by RomagnaBNB and must be paid by the check-in date.
6) TENANT'S DEFAULT
In case of withdrawal from the contract by the Tenant beyond the terms referred to in point 2) and/or in case of no-show, RomagnaBNB will retain the amount paid as a confirmation deposit, without prejudice to the right to compensation, for RomagnaBNB for the greatest damage suffered and suffered. In case of early check-out, RomagnaBNB is entitled to payment of the agreed amount for the entire stay, unless different and subsequent agreements have been made with RomagnaBNB itself.
7) PROPERTY USE
By signing this contract, the Tenant declares that the property, for the entire rental period, will be used exclusively as his own home and that of his family unit in the strict sense.
8) WASTE AND SMOKING BAN IN THE PROPERTY
The Tenant undertakes to carry out adequate separation of waste in accordance with the municipal/condominium regulations in force and, furthermore, formally acknowledges the absolute ban on smoking in all internal environments.
9) PROHIBITION OF SUBLEASE AND LOAN
The Tenant is expressly prohibited from sublease or loan the property, either totally or partially, under penalty of termination of the contract by law. (art. 1456 Civil Code.).
10) DATA COMMUNICATION ART. 109 T.U.L.P.S.
In order to comply with the general obligations of correctness and transparency as well as the specific ones regarding registration and communication to the Police Headquarters of the details of the residents provided for by the Art. 109 T.U.L.P.S. (public safety law), the Tenant will make available to RomagnaBNB suitable identification documents relating to all guests who will enjoy the stay in the home before allowing them access.
11) PROHIBITION TO ENTER FOREIGN PEOPLE INTO THE PROPERTY
The Tenant is prohibited from bringing into the accommodation people other than those for whom a suitable document has been made available and without the prior formal authorization of RomagnaBNB.
12) PROHIBITION TO MODIFICATION OF PROPERTY USE
The Tenant is expressly prohibited from modifying, either totally or partially, the agreed use of the property (residence) as well as transferring the rental contract, either totally or partially, to third parties.
13) RESPECT FOR THE RESIDENCE REGULATIONS AND PROHIBITION OF ILLEGAL CONDUCT THAT IS DEFECTIVE TO PUBLIC MORALITY AND GOOD DECORUM
The Tenant is also expressly prohibited from engaging in, directly or indirectly, any conduct contrary to the condominium regulations (where existing), just as the Tenant is expressly prohibited from engaging in, directly or indirectly, illegal conduct. or, in any case, harmful to public morality, good decorum or such as to cause harm to other condominium owners and/or owners/holders/usufructuaries of properties adjacent to the one covered by the rental contract.
14) TENANT RESPONSIBILITY
The Tenant is entirely responsible for the care of the house and its contents starting from the moment of check-in and is required to compensate for any damage caused, including costs relating to inadequate waste management and failure to comply with the smoking ban. in internal environments.
RomagnaBNB reserves the right to carry out inspections during the rental period, upon communication to the Tenant, in order to verify compliance with the contract conditions.
15) SECURITY DEPOSIT
To guarantee all the obligations undertaken, including the obligations of custody and punctual return of the home and without prejudice to the right to compensation for any greater damage suffered and being suffered by RomagnaBNB, the Tenant pays a deposit via an interest-free deposit for an amount equal to €100.00 (one hundred/00). The parties agree that, in the event of failure to fulfill the obligations undertaken under this contract, the Lessee will be required to pay the sum of €100.00 as a penalty to RomagnaBNB, which will be directly deducted from the sum paid by the Tenant to security deposit title, except for greater damage and subject to the provisions of article 2). Conversely, the security deposit, if the conditions are met, will be returned within 14 days after the check-out and cannot be calculated as a deposit of the agreed rental fee.
16) PAYMENT OF SECURITY DEPOSIT
The amount relating to the security deposit must be paid, in legal tender currency, by the Tenant to RomagnaBNB within the check-in time.
17) EXPRESS TERMINATION CLAUSE
The violation of one or more of the prohibitions referred to in this contract is to be understood as a serious breach of the contractual obligations placed on the Tenant and determines the immediate termination of the contract ope legis, with express renunciation by the Tenant of the return of the deposit paid and to any claim or request for compensation, with the Tenant's obligation to compensate for all damages suffered and to be suffered by the Owner and RomagnaBNB.
18) PROHIBITION OF REQUEST FOR RENTAL FEE REDUCTION
In consideration of the peculiarity and brevity of the use of the house, the Tenant, if the need to use the property for the agreed period ceases, in whole or in part, will not be able to request RomagnaBNB for a reduction, even partial, of the agreed rental fee.
19) ALTERNATIVE RENTAL OFFER
RomagnaBNB, if it no longer has the possibility of making the home available for all or part of the agreed period, will have to offer the Tenant a suitable alternative.
20) COMMUNICATION OF PERSONAL DATA
The Tenant expressly authorizes RomagnaBNB to provide their personal data to the administrator of the building or to third parties for obligations regarding the rental relationship or in any case connected to it, pursuant to EU Regulation 679 of 2026 and Legislative Decree. 196/2003, with subsequent amendments.
21) COMPETENT COURT
The parties signing this contract establish that the Court of Forlì will be competent for any possible future dispute arising from this contract, or directly/indirectly connected to it.
22) REGULATIONS
For anything not provided for in this contract, the parties make exclusive reference to the provisions of the italian civil code, current legislation on rental matters and local customs.
